Our legal team of GUGUM RIDHO & PARTNERS had succesfully assisted PT Visi Investama Properti (VIP), a large property company based in Jakarta. The disputes came over the negligence of The agreement of Zuriah Tower transaction, which was built and owned by VIP before that later bought and taken over by and changed the tower name into Perhutani Building. The panel of Judges found our claims are proven and then burden the defendant to pay for the loss arround 8 billion rupiahs.

After striving for more than one year of hearing session in South Jakarta District Court –usually not that long– but because of covid-19 restrictions, finally on November 15th 2022 the panel of judges then read the final decision.
The position of defendant (Perum Perhutani) as a state owned company made it quiet challenging and argumentative, even so the claims. Defendant presented the recomendations from state auditor to waive all of our claims due to the so called “late performance” by VIP on handling the certificate of occupancy (Sertifikat Laik Fungsi), the lisence from local authority — the provincial government of DKI Jakarta– to assure building’s legality and functionality, which later succesfully defended no late issues on it.
The panel of judges affirmed that state auditors recomendation has no legal impact because due to pacta sunservanda principle the agreement legally binding to both parties reciprocally like the law. The panel of Judges then found some of our claims are worth to be granted as it is founded and justified by law. This court decision is a good news for the Company’s credibility to keep on growing property bussines.
